Duration & Format
This is a semester-long course where participants attend evening lectures from 17:30 to 19:00 once a week during the period 15 July to 22 October 2024. Exams will take place between 30 October to 26 November 2024. Courses might be delivered through blended learning. Students are required to have basic computer skills and stable internet connection.

Overview
The Short-Term Insurance Law postgraduate certificate course analyses the insurance regulatory framework through the lens of judicial interpretation. The course will examine key themes in insurance law, as they have evolved through the cases presented. Practitioners will be provided with a practical understanding of how insurance legislation and case law has been interpreted and applied by the courts. The aim is to identify any gaps of interpretation and use the knowledge of the course to bridge those gaps.

Course Outcomes
On completion of the course, participants should be able to:

  • Critically assess the insurance law regulatory framework;
  • Apply judicial authority to the interpretation of insurance legislation;
  • Review and evaluate the implications of key insurance law court decisions for day-to-day decisions;
  • Apply case law to practical problems; and
  • Critically evaluate the Short-Term Insurance Act and any subsequent enactment.

Course Content
The course will cover the following topics:

  • Overview of insurance law;
  • Insurance Contracts and their requirements;
  • The interpretation of insurance contracts;
  • Misrepresentation;
  • Interpretation of section 53 of Short-Term Insurance Act 53 of 1998;
  • Warranties;
  • Subrogation;
  • Double Insurance, Over Insurance, Under Insurance and Reinsurance;
  • Assessment of a loss;
  • Exemption and limitation clauses; and
  • Reasonable Care.

Target Audience
Insurance professionals, claims managers, legal advisors, and individuals involved in the short-term insurance industry.

Application Process
A relevant law degree or at least 5 years work experience in insurance.

You will be required to submit a copy of your Bachelor’s Degree, academic record as well as a copy of your identity document or passport.

Kindly note that all foreign qualifications must be submitted with a SAQA Evaluation Letter.

Additional Information
One of the following certificates can be obtained:

  • Certificate of Attendance: To obtain a certificate of attendance, students are required to attend and participate in 75% of the lectures. 
  • Certificate of Competence: To obtain a certificate of competence, students are required to attend and participate in 75% of the lectures and to complete the assessments as required in the course.

This postgraduate certificate course is accredited by the university in accordance with its statutory mandate.  It does not lead to a qualification registered on the National Qualifications Framework.
